1. Agreement

These Terms & Conditions (“Terms”) are a legal agreement between you and Safety Electrical Services Pty Ltd (ACN 008 090 953, ABN 23 008 090 953), trading as HelpAlert (“HelpAlert”, “we”, “us”, “our”), of 25–29 Norman Road, Yatala Vale, South Australia 5126, Australia, governing your use of the HelpAlert mobile app and related services (the “Service”).

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Who can use HelpAlert

You must be at least 18 years old and able to form a binding contract. You agree to provide accurate information and to keep it up to date. You are responsible for activity under your account and for keeping your sign-in secure.

3. What HelpAlert is

HelpAlert lets a carer schedule automated welfare check-in calls for a cared-for person. At each scheduled time, the Service attempts to place an automated voice call and play a greeting the carer recorded. If the person does not respond, the Service attempts to notify the carer by push notification, email and/or voice call.

4. Important — HelpAlert is not an emergency service

HelpAlert is a convenience reminder-and-notification tool. It is NOT an emergency service, a medical device, a medical-alert or monitoring service, or a substitute for professional care.

  • In an emergency, call your local emergency number immediately (for example 911 in North America or 000 in Australia). Do not rely on HelpAlert to summon help.
  • HelpAlert does not guarantee that any call or notification will be placed, delivered, answered, or delivered on time. Calls and notifications depend on things outside our control, including mobile networks, telephone carriers, internet connectivity, third-party providers (see §11), app store services, device settings, and whether the cared-for person’s phone is on and in range.
  • A missed, failed, delayed, or unanswered call does not mean the cared-for person is safe or unsafe. HelpAlert does not verify a person’s wellbeing and cannot detect an emergency.
  • HelpAlert is not a guarantee of protection and is not a substitute for personal responsibility, in-person checks, professional care, or emergency services.

You accept these limitations and agree not to use HelpAlert as your only means of checking on someone’s safety.

5. Your responsibilities for the people you care for

When you add a cared-for person, you confirm that:

  • you have the authority and/or consent of that person (or their legal representative) to add their details and to arrange automated calls to them;
  • you have told that person that HelpAlert will call them, and who the calls are from; and
  • the phone number and other details you enter are accurate and are for the person you intend to contact.

You are responsible for the greeting you record and for keeping each person’s details and call schedule correct.

We may seek confirmation directly. We may ask the cared-for person to confirm that they agree to receive these calls before calls to them begin, and we may decline to place calls until they do. We may also stop calling a person at their request, whether they ask us directly or ask you. This is for their protection and does not reduce your responsibilities under this section.

6. Acceptable use

You agree not to:

  • use the Service for any unlawful, harassing, or harmful purpose, including unwanted or repeated calls to a person who has not consented;
  • enter phone numbers you are not authorised to contact;
  • attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service;
  • resell or commercially exploit the Service without our permission.

We may suspend or terminate your account if you breach these Terms.

7. Subscriptions, billing and renewals

  • Some features require a paid subscription. Subscriptions are offered on a recurring basis (for example monthly) and are billed through the Apple App Store or Google Play.
  • Subscriptions renew automatically at the then-current price until you cancel. You will be charged for each renewal period unless you cancel beforehand.
  • You manage and cancel your subscription through your Apple or Google account settings — not through us. Cancelling stops future renewals; it does not shorten the period you have already paid for.
  • Prices may change. We will give at least one month’s advance notice of a price change, and it will not take effect until your next renewal.
  • Refunds are handled under the policies of the app store you purchased through — Apple or Google — and you should direct refund requests to them. We do not process refunds directly. This does not affect any rights you have under consumer law that cannot be excluded (see §13).
  • Your subscription determines how many people you can care for at once. Reducing your plan may require you to remove people.

8. Free trials

We currently offer a 3-day free trial. Unless you cancel before the trial ends, it will automatically convert to a paid subscription at the then-current price. You can cancel any time before the trial ends through your app store account. Trial length and availability may change for new subscribers; the terms shown to you at the time you sign up are the ones that apply.

9. Your content and our licence

You keep ownership of the greeting recordings and information you provide. You grant us a licence to store, process, and use that content solely to provide the Service to you (for example, to play your greeting during a call). We do not use your content for any other purpose.

10. Our intellectual property

The Service, including its software, design, and branding, belongs to us or our licensors. We grant you a limited, personal, non-transferable, revocable licence to use the app for its intended purpose. You may not copy, modify, distribute, or create derivative works from it.

11. Third-party services

The Service relies on third parties to function, including telephone providers, push-notification and email providers, cloud storage, and the app stores. We are not responsible for the acts, omissions, outages, or policies of these third parties, and their availability is outside our control.

12. Service availability and changes

We aim to keep the Service running but do not guarantee it will be uninterrupted, error-free, or available at any particular time. We may modify, suspend, or discontinue any part of the Service.

We may update the app automatically, including by delivering updates over the air that apply without you reinstalling the app from the app store. We are not liable for any interruption or discontinuation.

13. Disclaimers and limitation of liability

To the maximum extent permitted by law:

  • The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, reliability, or that calls or notifications will be delivered.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from a missed, failed, delayed, or unanswered call or notification, or from any reliance on the Service to check on a person’s safety.
  • Our total liability to you for any claim relating to the Service is limited to the total amount you paid us for the Service in the 12 months before the claim.

Nothing in these Terms excludes rights that cannot be excluded under applicable law, including the non-excludable consumer guarantees under the Australian Consumer Law and mandatory rights under the consumer laws of the place where you live. Where such rights apply and cannot be excluded, our liability is limited to the extent permitted by that law — and where we are permitted to limit our liability for a consumer guarantee, we limit it to resupplying the Service or paying the cost of having it resupplied.

14. Indemnity

You agree to indemnify and hold us harmless from claims, losses, and expenses arising from your misuse of the Service, your breach of these Terms, or your entering the details of, or arranging calls to, a person you were not authorised to contact.

15. Termination

You may stop using the Service and delete your account at any time (Account → Delete Account). We may suspend or terminate your account if you breach these Terms or use the Service in a way that could harm others or us. Sections that by their nature should survive termination (including §4, §9, §10, §13, §14) will survive.

16. Changes to these Terms

We may update these Terms from time to time. We will change the “Last updated” date and, for significant changes, notify you in the app or by email at least one month before the change takes effect. Continuing to use the Service after a change means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of South Australia, Australia, without regard to conflict-of-law rules. You and we submit to the non-exclusive jurisdiction of the courts of South Australia and the courts able to hear appeals from them.

This does not take away your local consumer rights. If you live somewhere else, you keep the protection of any mandatory consumer laws of the country or state where you live that cannot be contracted out of, and nothing in this section prevents you from bringing a claim in your local courts where the law gives you that right.
